Are you eligible for Obamacare?

In order to be protected by the ACA act, you must satisfy the following conditions:


  • You should be living in the United States of America.

  • You must be a U.S. citizen or national (or be lawfully present).

  • You must not be serving a term in prison.

  • Moreover, if you already have Medicare coverage, you’re not eligible to use the Marketplace to buy a health or dental plan.


    What if I’m a U.S. citizen living outside the U.S.A

    If you are a U.S. citizen living in a foreign country for at least 330 days of a 12-month period, you need not get a health insurance coverage for that 12-month period. Since you qualify for a health insurance, it’s ok if you're uninsured and living abroad.


    Generally, health insurance in the Marketplace covers healthcare provided by doctors, hospitals, and other providers within the United States. If you're living abroad, it's important to know this before you consider buying Marketplace insurance.


    How can incarcerated people apply for Obamacare

    To clarify, to be incarcerated you must be serving a term in jail or prison.


  • Incarceration doesn’t include being on probation, parole, or home confinement.

  • If you are being held but not convicted of a crime (pending disposition of charges) you are not considered incarcerated.

  • How to apply after release from Incarceration

    After your release, depending on your household size and income during the year, you may qualify for lower costs on monthly premiums and out-of-pocket costs. After you’re released, you have a 60-day Special Enrollment Period to sign up for private health coverage. During this time, you can enroll in private health insurance even if it’s outside the Marketplace Open Enrollment Period.


    However, after expiry of this 60-day Special Enrollment Period, you can’t buy private health insurance until the next Marketplace Open Enrollment Period.
